d- Buyer: The person(s) requesting a reservation to receive service at the selected Restaurant/Hotel. The personal information provided at booking forms the basis of this agreement.
2. SUBJECT
Regulation of the terms regarding the sale, prepayment, or pre-authorization amount applicable to the reservation made by the Buyer for the Restaurant/Hotel.
3. GENERAL PROVISIONS
3.1. The Seller (Rezervem) collects from the Buyer’s card, via its own virtual POS, the amount determined by the Restaurant/Hotel for sale, prepayment, or pre-authorization.
The Buyer will enter card details on the payment link sent by the Seller or Intermediary. Amounts may vary by time/party size. The payment screen will clearly indicate whether the amount is processed as sale, pre-authorization, or prepayment.
3.2. The reservation is confirmed upon successful sale, prepayment, or pre-authorization. Confirmation is sent via SMS/email.
3.3. Upon arrival at the Restaurant/Hotel: The Seller (Rezervem) cancels the pre-authorization or deducts the prepayment as applicable. The Buyer is responsible only for the bill at the venue. Collected sale amounts are deducted from the bill.
3.4. Eligibility/age declaration, false info → suspension/cancellation. Rezervem (Intermediary) bears no liability where the venue cancels/denies entry due to this clause. Buyer indemnifies Seller’s losses arising therefrom.
3.5. If the venue changes date/time, Seller is not liable. If cancelled by the venue (non-Buyer fault), the sale, prepayment, or pre-authorization is refunded. Bank posting times may vary; Rezervem/venue not liable for bank delays.
3.6. Free cancellation until 12 (on iki) hours before reservation; the sale, prepayment, or pre-authorization is cancelled; if collected, refunded to the same card. For cancellations 12 hours or later, refunds are at the venue’s discretion. Buyer irrevocably accepts this.
3.7. No-show: outcome per the venue’s decision. ≥30 minutes late may be no-show. Buyer consents to charges under these terms.
3.8. Buyer may settle the bill online via the link; upon successful payment the account is closed.
3.9. Special events/shows: For prepayment, no refund (except force majeure). For pre-authorization, no-show/term breach may lead to full/partial capture per venue terms.
4. PERSONAL DATA
4.1. Seller processes personal data for contractual obligations under the PDPL.
4.2. Seller takes technical/organizational measures as per PDPL/Board decisions.
4.3. Buyer acknowledges having read the Privacy Notice.
5. NOTICES
5.1. Buyer sends notices to Rezervem’s contacts above; when necessary, notices are also forwarded to the venue.
6. DISPUTE RESOLUTION
6.1. Governed by Turkish Law; competent Consumer Arbitration Boards/Courts as per Law No. 6502.
7. ENTIRE AGREEMENT
7.1. Partial nullity does not invalidate remaining provisions.
8. EFFECTIVENESS
8.1. Buyer is deemed to accept this agreement upon completing the payment for the reservation.
Kişisel Verilerin Korunması ve İşlenmesine Dair Bilgilendirme
Rezervem Teknoloji Hizmetleri Anonim Şirketi (“Rezervem” olarak anılacaktır) olarak, siz müşterilerimize ait kişisel verileri hassasiyetle korumakta, veri sorumlusu sıfatına haiz olarak tüm yükümlülüklerimizi 6698 sayılı Kişisel Verilerin Korunması Kanunu (“KVKK” olarak anılacaktır) ve Avrupa Birliği Genel Veri Koruma Yönetmeliği (GDPR) uyarınca hukuka uygun olarak yerine getirmekteyiz.
1- Kişisel Verileriniz ve Edinme Yöntemlerimiz
Kişisel veri, belirli ya da belirlenebilir nitelikteki bir kişiye ilişkin her türlü bilgidir. Buna göre kişisel veri, adınız, soyadınız, adresiniz, telefon numaranız, e-mail adresiniz vb. tüm bilgilerinizi ifade etmektedir. Bizlerle telefonda veya yazılı olarak yahut elektronik ortamda paylaştığınız tüm bilgileriniz KVKK ve GDPR kapsamında işlenmektedir.
2- Kişisel Verilerinizin İşlenme Amacı, Hangi Şartlarda İşlenebileceği ve Aktarımı
Rezervem olarak,
- Aldığınız/alacağınız hizmet dolayısıyla yükümlülüklerimizi yerine getirmek,
- Rezervasyonları takip etmek ve düzenlemek,
- Faaliyet konusu kapsamında ilgili hizmetleri sunmak ve sunulan hizmetlerin kalitesini artırmak,
- Satış, pazarlama, tanıtım, reklam ve sair faaliyetleri yerine getirmek,
- Sizleri kampanyalar, yenilikler ve avantajlardan haberdar etmek,
- Destekçilere, iş ortaklarına ait etkinliklere ilişkin içerikler, olanaklar ve yeniliklerinden tarafınızı haberdar etmek,

Sizlere en iyi hizmeti sunabilmek amaçlarıyla, KVKK’nın 5. maddesi ve GDPR’ın 6. maddesinde belirtilen,
- Açık rızanızın varlığı,
- Kanunlarda açıkça öngörülmesi,
- Fiili imkansızlık nedeniyle rızasını açıklayamayacak durumda bulunan veya rızasına hukuki geçerlilik tanınmayan kişinin kendisinin ya da bir başkasının hayatı veya beden bütünlüğünün korunması için zorunlu olması,
- Bir sözleşmenin kurulması veya ifasıyla doğrudan doğruya ilgili olması kaydıyla sözleşmenin taraflarına ait kişisel verilerin işlenmesinin gerekli olması,
- Veri sorumlusunun hukuki yükümlülüğünü yerine getirebilmesi için zorunlu olması,
- İlgili kişinin kendisi tarafından alenileştirilmiş olması,
- Bir hakkın tesisi, kullanılması veya korunması için veri işlemenin zorunlu olması,
- İlgili kişinin temel hak ve özgürlüklerine zarar vermemek kaydıyla, veri sorumlusunun meşru menfaatleri için veri işlenmesinin zorunlu olması, işlenme şartlarından en az birisi var olduğu müddetçe bilgilerinizi toplamakta, kaydetmekte, depolamakta, muhafaza etmekte, hizmetlerimizi devam ettirebilmek amacıyla güncellemekte, düzenlemekte, aktarmakta, işlemekteyiz.
Restoranımız, web sitemiz ve diğer iletişim olanaklarımız üzerinden, sizlerden aldığımız kişisel verileriniz, mevzuatta belirlenen güvenlik ve gizlilik esasları uyarınca yeterli ve etkili önlemler alınmak kaydıyla; yasal zorunluluk gereği bu verileri talep etmeye yetkili olan kamu kurum veya kuruluşları, faaliyetlerimiz gereği anlaşmalı olduğumuz yurt içindeki ve dışındaki kurumlar ve iş ortaklarımız ile paylaşabilecektir.
KVKK ve GDPR’a uygun olarak, işbu Aydınlatma Metninde belirtilen amaçlarla işlenmiş olan kişisel verileriniz, KVKK 7. maddesi ve GDPR 17. maddesi gereğince işlenmesini gerektiren amaç ortadan kalktığında ve/veya mevzuat uyarınca Rezervem olarak verilerinizi işlememiz için zorunlu kılındığımız zamanaşımı süreleri dolduğunda tarafımızca silinecek, yok edilecek veya anonimleştirerek kullanılmaya devam edilecektir.
3- Veri Sahibi Olarak Haklarınız
KVKK’nın 11. maddesi ve GDPR’ın 15-22. maddeleri uyarınca veri sahibi olarak,
- Kişisel verilerinizin işlenip işlenmediğini öğrenme,
- Kişisel verileriniz işlenmişse buna ilişkin bilgi talep etme,
- Kişisel verilerinizin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
- Yurt içinde veya yurt dışında kişisel verilerinizin aktarıldığı üçüncü kişileri bilme,
- Kişisel verilerinizin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme,
- 7. ve 17. maddelerde öngörülen şartlar çerçevesinde kişisel verilerinizin silinmesini veya yok edilmesini isteme,
- Yukarıdaki iki madde uyarınca yapılan işlemlerin, kişisel verilerinizin aktarıldığı üçüncü kişilere bildirilmesini isteme,
- İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle şahsınız aleyhine bir sonucun ortaya çıkmasına itiraz etme,
- Kişisel verilerinizin kanuna aykırı olarak işlenmesi sebebiyle zarara uğramanız hâlinde zararın giderilmesini talep etme,
- Veri taşınabilirliği hakkınızı kullanma,
- Profil oluşturma ve otomatik karar verme süreçlerine itiraz etme haklarınız bulunmaktadır.
4- Veri Sahibi Olarak Şirketimize Başvuru Hakkınız
Yukarıdaki maddede bahsi geçen ve KVKK’nin 11. maddesi ile GDPR’ın 15-22. maddelerine göre sahip olduğunuz yasal haklarınız kapsamında taleplerinizi www.rezervem.com.tr internet sitesinde yer alan iletişim bilgilerini kullanarak, yazılı olarak veya info@rezervem.com.tr e-mail adresini kullanmak suretiyle bize iletebilirsiniz. Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ’in 5. maddesine göre yapacağınız başvuruda,
- Adınız, soyadınız ve başvurunuz yazılı ise imzanız,
- Türkiye Cumhuriyeti vatandaşı iseniz için T.C. kimlik numaranız,
- Türkiye Cumhuriyet vatandaşı değilseniz uyruğunuz, pasaport numaranız veya varsa kimlik numaranız,
- Tebligata esas yerleşim yeri veya iş yeri adresiniz,
- Varsa bildirime esas elektronik posta adresiniz, telefon ve faks numaranız,
- Talebinizin konusu, zorunlu olarak bulunmalıdır.

- Restaurant/Hotel: performance, cancellation/refund/no-show, invoicing
- PSP/Acquirer (Rezervem POS): authorization, pre-authorization/prepayment capture & settlement
- Infrastructure Providers: hosting, SMS/email, call center, security/logging
- Advisors/Public Authorities: legal/financial obligations and disputes
f) Retention
Data are retained for periods required by purpose and law (e.g., accounting records up to 10 years) and deleted/destroyed/ anonymized thereafter.
g) Commercial Messages
If you opt in to receive marketing messages from Rezervem, you may withdraw your consent at any time (unsubscribe links or info@rezervem.com.tr).
h) Your Rights & Applications (PDPL Art.11)
You may request information/access, rectification, erasure, objection to profiling, notice to third parties, and compensation for damages.

How Does the Provisioning Process Work?
How does the process work when you make a provision for your reservation?
- The provisioning process can only be made with credit cards with the provisioning feature enabled. No provision can be made for cash (Debit) cards.
- The provisioning process is not about getting a prepayment from you. It is only for confirming your reservation so that the business processes on the restaurant side can proceed correctly.
- When you enter your credit card information and complete the necessary steps, the provision amount is blocked on your credit card.
- This does not mean that your credit card has been charged. It's just blocked from your card limit. You can see this in the "Open Transactions" section on your credit card.
- The provision received is kept on your credit card until the reservation day.
- When you arrive at the restaurant, the authorization amount is canceled and automatically deducted from the "Open Transactions" section on your credit card.
- After this transaction, you cannot see any transaction in your card transactions because no financial transaction (collection/refund) has been made.
